The United States Agency for International Development (USAID) in Vietnam (USAID/Vietnam) is seeking applications for a Cooperative Agreement from qualified entities to implement the Strengthening Vietnam’s Commercial and Investment Alternative Dispute Resolution (ADR) Ecosystem Activity.
Alternative Dispute Resolution (ADR) in commercial and investment activities is an exercise through which contract related disputes are resolved by facilitated negotiation, conciliation/mediation, and arbitration. These mechanisms often replace formal court proceedings and may help reduce the pressure on the court system. In Vietnam, ADR formally consists of commercial arbitration and mediation.
Goal
To promote the utilization of commercial and investment Alternative Dispute Resolution (ADR) in Vietnam to improve rule of law, support judicial reform and enhance the business environment for both local and international businesses.
Objectives
- To enhance trust in the local commercial and investment ADR ecosystem by:
- Improving the ADR related legislation; and
- Strengthening capacity and skills of ADR stakeholders.
- To enhance awareness of local businesses on the benefits and availability of ADR
Components
- Support Vietnam’s ADR legislation reforms to remove legislation and enforcement challenges
- Enhance ADR professional skills and capacity of local ADR actors to improve enforceability and thus gaining more trust to the system
- Enhance awareness about ADR among current and future businesses especially local enterprises
Funding Information
- Subject to funding availability, USAID intends to provide up to $2,500,000 in total USAID funding.
- The period of performance anticipated herein is three years, starting from [actual date to be filled in at the time of award].
Geographic Focus
This is a nation-wide Activity and is designed for both national and local levels. However, the Recipient should focus its effort on provinces and cities which are considered economic and investment hubs where there are many exposures to dispute resolution opportunities in economic and investment areas.
