EU seeking Proposals for Promotion of Human Rights in Prisons and Small-Scale Artisanal Mines

The European Union (EU) has announced a call for proposals for the Promotion of Human Rights in Prisons and Small-Scale Artisanal Mines.

In response to the human rights situation at artisanal small-scale mining sites, particularly in the context of the fight against child labor, and in view of the scale of the phenomenon Burkina Faso, the European Union wished to contribute, from 2016 to the promotion and protection of human rights of populations through the establishment and development of integrated protection of human rights, particularly those of children at traditional gold mining sites.

Funding Information

The overall indicative amount made available under this call for proposals is 1,250 000 EUR. The Contracting Authority reserves the right not to allocate all of the available funds.

Any grant requested under this call for proposals must be between the following minimum and maximum amounts:

• Lot 1: Improvement of prisoners’ rights by legal and judicial assistance and Reintegration
  • Minimum amount: 500,000 EUR
  • Maximum amount: 625,000 EUR
• Lot 2: Improvement of human rights in mines small-scale crafts (MAPE)
  • Minimum amount: 500,000 EUR
  • Maximum amount: 625,000 EUR

Objectives

The general objective of this call for proposals is to promote the human rights of prisoners in through the improvement of prison conditions and those of the populations directly involved and indirectly in artisanal small-scale mines.

The specific objectives of this call for proposals (SO) are:

• SO1: Improve the rights of prisoners through legal and judicial assistance and reintegration social. The expected results are:
  • Reintegration and vocational training actions are organized and implemented,
  • Legal and judicial advice to detainees is organized and implemented,
  • Steering, monitoring, and follow-up of respect for fundamental rights in prisons and places detention in Burkina Faso are carried out by all stakeholders at the local level and national level.
• SO2: Promote the human rights and fundamental freedoms of the population living and/or working in traditional gold washing sites of artisanal small-scale mines (MAPE) in strengthening their access to human, social and economic rights and contributing to the regulation of artisanal mining sector through an integrated approach with all stakeholders. The expected results are:
  • Integrated human rights protection systems are reinforced and duplicated on the MAPE of Burkina Faso,
  • Steering, monitoring, and follow-up of the human rights situation in MAPEs in Burkina Faso are provided by all stakeholders at the local and national level,
  • Regulatory processes between MAPEs, village communities, and municipalities are established and contribute to improving local governance of the artisanal mining sector.

The added value elements of this call for proposals: During the evaluation process, the priority will be awarded to the action which takes into account one or more of the following aspects:

• The action is designed and carried out on the basis of a diagnosis (development plan, feasibility study, etc.). Preparatory work, past experiences, lessons learned and recommendations from projects in the same lineage as the proposed action should be put forward in the proposal.
• The action proposes a coherent and integrated approach to deal with human rights issues at the level of local and national and with the participation of all stakeholders.
• The proposal takes into account in a systematic and clearly defined way in the problem to be solved and in the methodology, issues of gender equality, children’s rights, human rights with disabilities, minority rights.
• The action integrates an approach of know-how, ways of doing, and speaking with the target groups concerned, in particular, the artisanal miners, their representatives and neighboring communities, prisoners, their families, prison staff, and those working in the prison system.
• The action of NGOs and development associations is part of the various policies for the protection of human rights of the State, in line with the orientations of public structures, both at the national level than local.
• The action shows a good knowledge of national policies for the protection of human rights and current programs, it creates synergies and complementarity with the actions of the State and society.
• The action ensures the monitoring of respect for human rights in collaboration with a national collective association and in connection with the National Human Rights Commission (on mine sites small-scale crafts and places of detention).
• The action envisages a cascade subsidy program, allowing, for example, organizations social organizations, recently formed organizations or organizations that do not have the capacity to the management of large-scale projects or organizations not familiar with the procedures the European Union, to contribute to the achievement of the results of the action and to benefit from access to European funding to build their capacities and/or implement targeted and valuable activities strong addition, making it possible to amplify the scope and quality of the action (financial support to third parties).
• The action sensitizes target groups and beneficiaries on topics relating to hygiene, sport, and risky behavior taking into account COVID-19.
• The action promotes good practices, innovative actions, effective and adapted to the context.
• The action contributes to improving the living conditions of detainees in establishments and places of detention as well as on traditional gold panning sites taking gender into account (man/gem, adult/minor) and youth.
• The proposal demonstrates how the monitoring and evaluation of the project will be carried out internally, and in particular how implementation progress will be compared to the work program, indicators, and framework logic initials, and how often.
• The proposal provides for one or more external evaluation (s).

Eligibility Criteria

Lead applicant(s)

To be eligible for a grant, the lead applicant must:

• be a legal person and
• have no profit motive and
• belong to one of the following categories of organizations: non-governmental organization, as defined in Article 156 of the Financial Regulation of the European Union and
• be established in Burkina Faso and/or in an eligible third country when in the latter case the statutes are registered locally, and/or a memorandum of understanding has been concluded and
• be directly responsible for the preparation and management of the action with the co-applicants and the entity or affiliated entities, and not act as an intermediary and
• have an official representation in Burkina Faso with permanent staff and
• prove that they have regularly carried out activities for a period exceeding 2 years in the area of the lot for which the proposal was submitted.

Co-applicant(s)

• Co-applicants participate in the development and implementation of the action, and the costs they support are eligible in the same way as those supported by the lead applicant.
• Co-applicants must meet the same eligibility criteria as those that apply to the lead applicant himself.
• Co-applicants must sign the mandate.
• If the grant is awarded to them, potential co-applicants become beneficiaries within the framework of the action (with the coordinator).

Affiliated Entities

• The lead applicant and his co-applicant (s) may act with one or more affiliated entities.
• Only the following entities can be considered as affiliated with the lead applicant and / or to the co-applicant (s):
  • Only entities that have a structural link with the applicants (the lead applicant or a co-applicant), in particular a legal or capital link.
  • This structural link mainly encompasses two concepts:
    • control, within the meaning of Directive 2013/34 / EU relating to annual financial statements, consolidated financial statements, and related reports of certain types of companies:
      • Entities affiliated with an applicant can therefore be:
        • entities controlled directly or indirectly by the applicant (subsidiaries or subsidiaries of the first rank) or controlled by an entity itself controlled by the applicant (sub-subsidiaries or second-level subsidiaries), and this is valid for the other control levels;
        • entities directly or indirectly controlling the applicant (parent companies). Of the likewise, they may be entities controlling an entity controlling the requester;
        • entities controlled, directly or indirectly, at the same level as the applicant (sister companies).
    • membership, i.e. the applicant is legally defined as, for example, a network, a federation or association of which the proposed affiliate is a member of the applicant is a member of the same entity (for example, a network, a federation, an association, etc.) as the proposed affiliate.
