To improve access to HLP for IDPs and affected communities, UNDP wishes to establish long term partnerships with CSOs and strengthen their legal capacity and response in Northern Shan to reach underserved populations and support them to access their HLP rights.
One of the longer-term aims of this grantmaking initiative, therefore, is to support CSOs to uphold people’s HLP rights and promote security of tenure. In addition, Strengthening Accountability and Rule of Law (SARL) intends to strengthen the capacity of CSOs in Northern Shan to improve their organizational effectiveness and sustainability beyond the lifetime of SARL Project, and will promote advocacy activities and dialogue between CSOs, government and donors.
UNDP has a particular interest in reaching disadvantaged, remote or otherwise hard to reach populations, and groups facing discrimination or marginalization. CSOs are uniquely positioned to reach underserved populations, understand their needs and develop strategies for working with them. However, to date few CSOs have received in-depth training on HLP issues, making it difficult for them to effectively inform, advise and support the communities they work with on such technically complex matters.
Purpose
The specific objectives of this Call for Grant Applications are for CSOs to:
- Provide legal awareness raising activities to IDPs and affected communities.
- Conduct land mapping and monitoring land claims in IDPs villages of origin and those by affected communities and provide support for registration of land title.
- Provide legal aid services to IDPs, affected communities and disadvantaged persons.
The main outputs are as follows:
- Legal awareness raising:
- Conduct outreach to community leaders and local government officials at the Village, Township, District and State level to ensure their cooperation and understanding of the purposes of the awareness raising activities, in collaboration with UNDP.
- Conduct legal awareness raising for IDPs and affected communities on HLP issues including land law, registration processes under different land regime, objection claims procedure and dispute resolution.
- Prepare information materials on HLP rights and registration including illustrated posters and post these in different IDP camps and strategic locations in multiple townships.
- Participate and support education efforts organized by UNDP as needed.
- Land mapping and monitoring of claims, registration of title
- Monitor land claims in IDPs villages of origin and villages of affected communities and assist to draft and file objection claims.
- Conduct participatory land mapping in IDPs villages of origin and villages of affected communities and work with land administration bodies to conduct boundary demarcation.
- Assist IDPs and affected communities to prepare land registration documents and accompany them where possible to engage land administration authorities over land registration.
- Provision of legal assistance:
- Provide in-person, direct legal consultations and advice (out of court) through mobile an office-based legal aid clinics.
- Provide in-person, direct legal services to persons who appear in court in criminal and civil cases related to HLP.
- Provide legal consultation/advice to persons with HLP related problemsthroughout Northern Shan State through a telephone hotline and dedicated social media accountin Burmese, Shan and other minority languages, and publicize its availability.
Budget Size and Duration
- The budget for any grant application submitted by an applicant organisation should fall within the range of USD 20,000 to a maximum of USD 80,000.
- In principle, project duration will be 12 months depending on actual start date; shorter periods may be considered for lower value proposals.
Eligible Beneficiaries
Eligible beneficiaries of assistance to be provided:
- Eligible beneficiaries will be poor and disadvantaged individuals and groups in any township and location in Northern Shan State, Myanmar. The applicant organisation should clarify how it will identify these beneficiaries and what criteria it will use.
- A minimum of 50% of these people will be women and girls, preferably more.
- Special consideration should be shown for reaching people from ethnic minority groups, people with disabilities, and any particular group that in the opinion of the applicant organisation is disadvantaged and/or marginalised with respect to HLP rights.
Eligible Organisations
Eligible organisations are Myanmar Civil Society Organisations that work on community development, raising awareness on HLP issues including land law, registration processes and dispute resolution; conducting land mapping and monitoring land claims; and, provision of legal aid services in Northern Shan State targeting townships and locations within and outside of Lashio.
Eligibility Criteria
- Must be a Myanmar Civil Society Organisation with operations already established in Northern Shan State.
- Having the necessary permission to provide the services outlined in this TOR in the agreed locations (evidenced by registration, ongoing application for registration, or endorsement from the relevant authorities).
- A track record of at least three years in development work preferably in land rights, community development and awareness raising targeting disadvantaged and/or underserved populations in Northern Shan State.
